1. Acceptance
By creating an account or using Giggy, you accept these Terms. If you do not accept them, do not use Giggy.
2. Service Description
Giggy is a utility app for delivery and gig-economy drivers. It helps users review offer information, track earnings and mileage, manage order history, view analytics, import or export data, and manage account and subscription status.
Giggy may include:
- Manual order entry and scoring
- Offer detection and analysis tools
- Android AccessibilityService-based visible offer reading if you choose to enable it
- iPhone screenshot OCR and user-started ReplayKit live OCR with Apple system indicators
- GPS-based mileage tracking and trip history
- Reports, analytics, and profitability metrics
- Import, export, and backup-related data tools
- Giggy AI coaching (optional) — uses your past history only when you ask a question
- Optional cloud backup (off by default) for restore on a new device
- Account, entitlement, and subscription management
3. Giggy AI
Giggy AI is optional and off by default until you enable it. When you ask a question, Giggy sends your question, recent chat history, and summary statistics from your past driving history (earnings, hours, platforms, offer totals — not customer addresses) to Google Gemini through Firebase Cloud Functions to generate an answer. This is the only purposeful use of your driving history off-device.
Voice input uses your device microphone for on-device speech-to-text. Do not include customer names, addresses, or other personal information in questions.
4. Cloud Backup
Cloud backup is optional and off by default. When you enable it, Giggy uploads orders, trip route points, receipt metadata, and sync timestamps to Firebase Firestore for your signed-in account so you can restore them. Giggy does not use backup data for any purpose other than storage and restore.
5. Offer Detection and Screen Reading
Giggy uses different platform-appropriate methods for offer detection.
- On Android, Giggy can use AccessibilityService or optional MediaProjection OCR (with per-session system consent) to read visible delivery-offer details from supported delivery-app screens if you choose to enable them. Giggy processes offer text on device and does not upload screen frames for recognition. Giggy does not use these tools to read personal messages, passwords, keystrokes, or unrelated app content.
- On iPhone, Giggy does not silently read other apps and does not place custom floating overlays over delivery apps. Screenshot OCR only reads images you choose. Live OCR requires you to manually start an iOS ReplayKit screen broadcast and Apple shows system indicators while it is active. Broadcast frames and screenshots are processed on device for delivery-offer detection.
- For all platforms, offer detection features are optional. Giggy does not intentionally record continuous screen video or audio for cloud storage, and it does not use offer-detection permissions to monitor unrelated personal content.
6. Location and Notifications
Giggy offers optional GPS-based mileage tracking. If you turn that feature on, Giggy may use location while tracking is active to record mileage during delivery shifts.
When tracking or alerts are enabled:
- Giggy may show a persistent system notification or operating-system indicator where required.
- Giggy may send local notifications for mileage reminders, session alerts, or detected offers if you enable notifications.
Location tracking is optional. Notifications are optional. You can disable location access and notifications in Giggy or your device settings, and you can stop iPhone live OCR by ending the ReplayKit broadcast.
7. Photos, Files, and User Content
If you choose a profile image or import or export file, Giggy uses system pickers or system share flows where available. This access is optional, limited to content you choose, and not required to use Giggy.
Giggy may store local file paths, imported records, exported files, notes, flags, goals, onboarding state, and related settings you choose to save.
8. Subscriptions and Payments
Giggy offers free and premium features. Paid subscriptions are handled by the platform store for your device.
- On Android, Google Play handles billing, renewals, cancellations, and payment processing.
- On iPhone, Apple App Store handles billing, renewals, cancellations, and payment processing.
- Subscriptions bill immediately through your store when you subscribe and renew automatically unless cancelled through your store account before the billing period ends. BetterDays LLC does not directly receive or store your payment card details.
- Friend referral and creator codes may grant banked premium days of Giggy Premium. Banked days apply when you do not have an active paid subscription and are paused while one is active. See the in-app Referral & Creator Code Program for details.
9. User Responsibilities
You agree to use Giggy lawfully and follow all applicable laws, use only accounts and payment methods you own or control, keep your credentials secure, follow the terms and policies of the delivery platforms and third-party services you use with Giggy, drive safely, verify Giggy's calculations before relying on them for business or tax decisions, and not reverse engineer, tamper with, or disrupt Giggy or its systems.
10. Accuracy and Business Disclaimers
Giggy provides estimates based on parsed screen data, user input, saved history, and fixed calculation assumptions. Giggy does not guarantee accurate earnings calculations or projections, profitability, job availability, tax or legal advice, uninterrupted service, error-free operation, or continued compatibility with every delivery-platform app or interface.
You are responsible for checking Giggy's output and consulting qualified professionals when needed.
11. Third-Party Services and Non-Affiliation
Giggy depends on third-party services, which may include Firebase, Google Sign-In, Google Play, Apple App Store services, and third-party delivery-platform apps.
Giggy is not affiliated with, endorsed by, or sponsored by DoorDash, Uber Eats, Instacart, Grubhub, Amazon Flex, Walmart Spark, Lyft, Google, Apple, Firebase, or other third-party providers.
12. Data, Account, and Exit Choices
You may use guest mode where available, enable or disable Giggy AI and Cloud Backup in settings, log out at any time, export and import local data using Giggy's tools, clear local app data through Giggy or device settings, delete your account through the in-app deletion flow, or stop using the app at any time.
Deleting the app does not automatically delete cloud account data. Account deletion removes cloud account records through the app's deletion workflow.
13. Prohibited Conduct
You must not reverse engineer, decompile, or tamper with Giggy or its systems, bypass subscription controls, use Giggy to violate laws or third-party terms, abuse permissions or security controls, or use Giggy to monitor unrelated personal content or perform surveillance.
14. Termination and Restrictions
BetterDays LLC may restrict or terminate access to Giggy for fraud, abuse, misuse, non-payment, security risks, unauthorized access attempts, legal requirements, or violations of these Terms.
15. Warranty Disclaimer
Giggy is provided "as is" and "as available." BetterDays LLC makes no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or security.
16. Limitation of Liability
To the fullest extent allowed by law, BetterDays LLC is not liable for indirect, incidental, special, consequential, punitive, or business-loss damages. This includes lost profits, lost data, service interruptions, calculation errors, and decisions you make based on Giggy's output.
17. Indemnification
You agree to indemnify and hold harmless BetterDays LLC, its officers, employees, and agents from claims, losses, liabilities, expenses, and legal fees arising from your use of Giggy, your violation of these Terms or applicable law, or your violation of third-party terms.
18. Governing Law and Venue
These Terms are governed by the laws of South Carolina, United States, without regard to conflict-of-law rules. Any legal action arising under these Terms must be filed in the state or federal courts located in South Carolina, unless law requires a different forum.
19. Changes to Terms
BetterDays LLC may update these Terms by publishing a revised version with a new effective date in the app settings or on the website. If you continue using Giggy after the update takes effect, you accept the revised Terms.
